Terms of Service

By accessing or using the KloudKreate website or engaging our services you agree to be bound by these Terms of Service. If you do not agree to these terms please do not use our website or services.

KloudKreate provides digital marketing, web development, AI systems, CRM implementation, application development and design services. The specific scope, deliverables, timeline and fees for any engagement are outlined in a separate proposal or service agreement provided to the client prior to commencement of work.

Clients are responsible for providing accurate and complete information necessary for us to deliver the agreed services. Clients must provide timely feedback, approvals and any materials required within agreed timeframes. Delays caused by the client may affect delivery timelines and KloudKreate accepts no liability for such delays.

Payment terms are specified in the individual service agreement or proposal. Unless otherwise agreed a deposit is required before work commences. Late payments may result in work being paused until outstanding amounts are settled. All fees are non-refundable unless otherwise specified in writing.

Upon receipt of full payment clients receive ownership of the final deliverables created specifically for them under their service agreement. KloudKreate retains ownership of all proprietary tools, frameworks, methodologies and pre-existing intellectual property used in the delivery of services. KloudKreate reserves the right to display completed work in its portfolio unless otherwise agreed in writing.

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This obligation survives the termination of any service agreement.

KloudKreate will perform all services with reasonable skill and care. However we do not guarantee specific results including but not limited to search engine rankings, advertising performance, revenue growth or conversion rates. Our total liability to any client shall not exceed the total fees paid by that client in the three months preceding any claim.

Our website and services are provided on an as-is basis. We make no warranties express or implied regarding the accuracy, completeness or suitability of any information on our website. We reserve the right to modify or discontinue any aspect of our services at any time.

Either party may terminate a service agreement with written notice as specified in the individual agreement. Upon termination the client is responsible for payment of all work completed up to the termination date. KloudKreate will provide all completed work and assets to the client upon receipt of any outstanding payments.

These Terms of Service are governed by the laws of the United Arab Emirates. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our website or services after changes constitutes acceptance of the updated terms.
